What is a general power of attorney?
A general power of attorney (also called 'general authorisation') is a document that grants a person comprehensive powers of representation. Unlike a specific power of attorney, which only applies to a particular purpose, the general power of attorney covers all legal transactions.
In Switzerland, the power of attorney is based on the Code of Obligations (OR, Art. 32 ff.). It is immediately valid, even when you are still capable. This distinguishes it from the advance care directive, which only takes effect upon incapacity.
Writing a power of attorney: Guide
A power of attorney in Switzerland must contain the following elements:
- Details of the principal: Full name, date of birth and address
- Details of the authorised person: Name, date of birth and address of the authorised person
- Scope of the power of attorney: For a general power of attorney: 'comprehensive representation in all matters'
- Duration of validity: Unlimited or limited by date
- Place and date of issue
- Handwritten signature of the principal
Tip: For particularly important legal transactions (e.g. property sales), a notarised power of attorney may be required. Check this in advance.
